The general terms and conditions for the provision of excursion services determine the mutual relations, rights and obligations between BY ELLI, business for the provision of tourist services – OIB: 15112176977, from Poreč (hereinafter BY ELLI) and the guest/passenger based on the place reservation.
Application for seat reservation
The guest can send his application or reservation to BY ELLI through the reservation on the website. When making a reservation, the guest is obliged to provide true information.
Reservations and payments
When making a reservation, the guest confirms that he is familiar with these General Terms and Conditions of Purchase and thereby concludes the Reservation Agreement. The reservation is considered valid only after payment by the guest, unless otherwise specified in the Agreement. Any other type of booking confirmation is not considered valid. Payment can be made to the account by credit card or PayPal. If the guest does not fulfill his obligation from the Agreement or the General Conditions, if there is no concluded Agreement, it will be considered that he has given up the reservation without the possibility of returning the amount paid.
Termination of the contract by the organizer
BY ELLI can terminate the reservation contract and return all payments received to the guest without compensation if extraordinary circumstances occur that could not be avoided. In that case, BY ELLI is obliged to return the received payments no later than 7 days after the termination of the contract.
The guest’s right to terminate the contract
The Guest may terminate the Travel Agreement in writing up to 24 hours in advance for a full refund prior to the start of the excursion.
Liability for booking errors
BY ELLI is responsible for all errors caused by technical faults in the reservation system that can be attributed to it, while the guest is responsible for all errors that can be attributed to the guest (eg incorrect name and surname or some other information). BY ELLI is not responsible for errors in reservations caused by extraordinary circumstances that could not be avoided.
Resolving complaints
If the guest wants to file a complaint about the performance of the service, it is in the guest’s interest to do so immediately to the final service provider in order to proceed with error correction or service improvement.
